Your duty to take reasonable care

Go Insurance provides travel insurance for Australian travellers. Before you enter into an insurance contract with us, you have a duty to take reasonable care not to make a misrepresentation to us when answering questions that we will ask you and providing us with information.

Before you enter into, vary or extend an insurance contract, we will ask you questions that are relevant to our decision to insure you and on what terms.

You must take reasonable care not to make a misrepresentation to us when answering those questions. For example, it is important that you answer our questions fully and accurately, to the best of your knowledge.

Why It Matters

What happens if the duty isn’t met

If you do not take reasonable care not to make a misrepresentation to us, we may cancel your contract, or deny or reduce the amount we will pay you for a claim, in accordance with our rights at law.

If you make a misrepresentation to us which is fraudulent, we can:

Treat your policy as if it never existed (i.e. avoid the contract), unless we would have entered into the contract for the same premium and on the same terms anyway; or
If we are not entitled to avoid the contract, or we decide not to avoid the contract, we can reduce the amount that we pay you for a claim so that we are put in the position we would have been in if you had not breached your duty to us, in accordance with our rights at law.

Our questions are designed to be clear and specific, so you know exactly what we need. For travel insurance, they typically cover:

Who is travelling, including each traveller’s age and residency
Your destinations and travel dates
Existing medical conditions, for you and anyone whose health your trip depends on
The activities you plan to take part in, and any optional cover you want to add
Your claims history and any relevant insurance history

You only need to answer the questions we ask — you don’t need to volunteer information we haven’t asked for. If a question isn’t clear, please ask us before you answer.

Before You Travel

If something changes

If you need to vary or extend your policy, the duty applies again at that point — so the same care is needed when you answer our questions.

If your circumstances change after you buy — for example, a new medical diagnosis, or a change to your destinations or activities — contact us so we can tell you whether it affects your cover.

What is my duty when I buy travel insurance?

You have a duty to take reasonable care not to make a misrepresentation to us — that is, to answer our questions fully and accurately, to the best of your knowledge, when you enter into, vary or extend a policy.

Do I have to tell you things you haven’t asked about?

No. Your duty relates to the questions we ask you. Answer those fully and accurately; you don’t need to volunteer information we haven’t requested. If you’re unsure what a question covers, just ask us.

What happens if I get something wrong by accident?

If you haven’t taken reasonable care not to make a misrepresentation, we may cancel your contract, or deny or reduce a claim payment, in accordance with our rights at law. What happens depends on the circumstances — including what we would have done had we known the correct information.

What if the misrepresentation was deliberate?

If a misrepresentation is fraudulent, we can treat the policy as if it never existed, unless we would have insured you on the same premium and terms anyway. Alternatively, we can reduce what we pay on a claim to put us in the position we would have been in had the duty not been breached.

Does the duty apply again if I extend my policy?

Yes. The duty applies whenever you enter into, vary or extend a contract, so take the same care each time you answer our questions.

What if my health or plans change after I buy?

Contact us on 1300 819 888. A new diagnosis or a change to your destinations or activities can affect your cover, and we can tell you what it means for your policy before you travel.

Who answers the questions if I’m booking for my family?

Whoever completes the application must answer accurately for every traveller on the policy. If someone applies on your behalf, check the answers given are correct — the duty applies to the information provided for all insured people.
